Hak ve \u00f6zg\u00fcrl\u00fckler, gereksinimler ve isteklerin talebe ve m\u00fccadeleye d\u00f6n\u00fc\u015fmesi sonucunda ortaya \u00e7\u0131km\u0131\u015f, \u00e7at\u0131\u015fan \u00e7\u0131karlar ve \u00e7eli\u015fkiler vas\u0131tas\u0131yla da evrimle\u015fmi\u015ftir. Bu haklara ili\u015fkin m\u00fccadele 17. ve 18. y\u00fczy\u0131llarda ya\u015fanan feodal sistemin \u00e7\u00f6k\u00fc\u015f\u00fc ve burjuvazinin ayaklanmas\u0131na dayan\u0131r ve ki\u015finin kendi hakk\u0131nda tasarrufunun korunmas\u0131 temellidir. Bunu 19. y\u00fczy\u0131lda sanayi devrimi ve i\u015f\u00e7i s\u0131n\u0131f\u0131n\u0131n ilk ku\u015fak haklardan e\u015fit yararlanma m\u00fccadeleleri sonucunda ortaya \u00e7\u0131kan sosyal, iktisadi, k\u00fclt\u00fcrel hak ve \u00f6zg\u00fcrl\u00fcklerin te\u015fkil etti\u011fi ikinci ku\u015fak hak ve \u00f6zg\u00fcrl\u00fckler takip etmi\u015ftir. \u0130kinci D\u00fcnya Sava\u015f\u0131 sonras\u0131na gelindi\u011findeyse art\u0131k uluslararas\u0131la\u015fma ve teknolojik geli\u015fmelerin gerekli k\u0131ld\u0131\u011f\u0131 \u00e7evre, geli\u015fme, bar\u0131\u015f ve insanl\u0131\u011f\u0131n ortak mal varl\u0131\u011f\u0131na sayg\u0131 hakk\u0131n\u0131n olu\u015fturdu\u011fu \u00fc\u00e7\u00fcnc\u00fc ku\u015fak haklar g\u00fcndeme gelmi\u015ftir (Kabo\u011flu, 2005; Kabo\u011flu, 1989).<\/p>\n\n\n\n<p>Kabo\u011flu (2005), ya\u015fama hakk\u0131n\u0131 temel alarak k\u0131saca; ilk ku\u015fak haklar i\u00e7in \u201cg\u00fcvenlik i\u00e7inde ya\u015fama hakk\u0131\u201d, ikinci ku\u015fak haklar i\u00e7in \u201conur i\u00e7inde ya\u015fama hakk\u0131\u201d ve \u00fc\u00e7\u00fcnc\u00fc ku\u015fak haklar i\u00e7inse \u201cuygun \u00e7evrede ve bar\u0131\u015f i\u00e7inde ya\u015fama hakk\u0131\u201d kavramlar\u0131n\u0131 \u00f6nermi\u015ftir.&nbsp;<\/p>\n\n\n\n<p>Asgari standartlar\u0131 net bir \u015fekilde belirli olmayan dil haklar\u0131, insan haklar\u0131 ku\u015faklar\u0131 i\u00e7erisinde de sabit bir kategoriye \u00f6zg\u00fc de\u011fildir. Farkl\u0131 toplumlar\u0131n dilleri ihtiya\u00e7lar\u0131na g\u00f6re \u015fekillenmi\u015ftir. \u0130\u00e7inde bulunduklar\u0131 iklimsel ve do\u011fa ko\u015fullar\u0131 ile k\u00fclt\u00fcrleri do\u011frultusunda dilleri, ifade etmek istedikleri anlamlar\u0131 kar\u015f\u0131lamas\u0131 y\u00f6n\u00fcnde, yani ileti\u015fimin verimli sa\u011flanabilmesi i\u00e7in d\u00f6n\u00fc\u015f\u00fcp de\u011fi\u015fime u\u011fram\u0131\u015ft\u0131r. \u0130leti\u015fimsel ihtiya\u00e7lar do\u011frultusunda olu\u015fan diller, topluluklar\u0131n kimliklerini yans\u0131tan en \u00f6nemli bile\u015fenlerden biridir. Dilin bu iki y\u00f6n\u00fc birbirine ba\u011fl\u0131d\u0131r ancak farkl\u0131 d\u00f6nemlerde dilin farkl\u0131 i\u015flevleri tehdit alt\u0131nda hissedilebilir ya da \u00f6n plana \u00e7\u0131kabilir. \u0130leti\u015fimsel i\u015flevini kaybeden diller, baz\u0131 durumlarda sembolik i\u015flevlerini s\u00fcrd\u00fcrebilmektedirler (Edwards, 2013). \u00dclkemizde art\u0131k g\u00fcnl\u00fck ya\u015famda neredeyse hi\u00e7 kullan\u0131lmayan ancak kimliksel fonksiyonu sebebiyle dil haklar\u0131 m\u00fccadelesine konu olan diller bu duruma \u00f6rnek olarak g\u00f6sterilebilir.&nbsp;\u00c7ukurova B\u00f6lgesi Arap leh\u00e7esi de ileti\u015fimsel fonksiyonunu g\u00fcnden g\u00fcne kaybetmektedir. B\u00f6lge leh\u00e7esinin g\u00fcn\u00fcm\u00fczde daha \u00e7ok k\u00fclt\u00fcrel ve dinsel aktar\u0131m i\u015flevi g\u00f6rd\u00fc\u011f\u00fc s\u00f6ylenebilir.<\/p>\n\n\n\n<p>Mevcut g\u00f6r\u00fcn\u00fcmde dil haklar\u0131 bir\u00e7ok \u00fclkede ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcnden e\u011fitim \u00f6zg\u00fcrl\u00fc\u011f\u00fcne kadar bir\u00e7ok farkl\u0131 insan hakk\u0131 kapsam\u0131nda korunmaya devam etmektedir. \u0130lk ku\u015fak haklar olan ki\u015fi \u00f6zg\u00fcrl\u00fcklerinden d\u00fc\u015f\u00fcnce, ifade, din, vicdan ve inan\u00e7 \u00f6zg\u00fcrl\u00fckleri ile dernek, toplant\u0131, g\u00f6steri, y\u00fcr\u00fcy\u00fc\u015f haklar\u0131 gibi toplu eylem \u00f6zg\u00fcrl\u00fckleri; ikinci ku\u015fak haklardan olan iktisadi, sosyal ve k\u00fclt\u00fcrel haklardan toplumsal ileti\u015fim \u00f6zg\u00fcrl\u00fckleri, e\u011fitim ve \u00f6\u011fretim hakk\u0131; \u00fc\u00e7\u00fcnc\u00fc ku\u015fak haklardan geli\u015fme hakk\u0131 sosyal, k\u00fclt\u00fcrel, siyasal, hukuksal geli\u015fme, ki\u015fili\u011fi serbest\u00e7e geli\u015ftirme, k\u00fclt\u00fcrel kimli\u011fe sayg\u0131, az\u0131nl\u0131k haklar\u0131 gibi haklar\u0131n dil hakk\u0131n\u0131n farkl\u0131 kullan\u0131mlar\u0131n\u0131 te\u015fkil etti\u011fi s\u00f6ylenebilir. Her ne kadar temel insan haklar\u0131 kapsam\u0131nda kullan\u0131m dil haklar\u0131n\u0131n korunmas\u0131 i\u00e7in yeterli olmasa da s\u0131n\u0131rl\u0131 olarak belirli bir koruma sa\u011fland\u0131\u011f\u0131 s\u00f6ylenebilir.&nbsp;T\u00fcm insanlara tan\u0131nan genel insan haklar\u0131ndan ayr\u0131mc\u0131l\u0131k yasa\u011f\u0131, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc ile aile ve \u00f6zel ya\u015fama sayg\u0131 haklar\u0131 tolerans yoluyla belirli bir dil haklar\u0131 korumas\u0131 sa\u011flar. Ancak dil haklar\u0131n\u0131n tam manas\u0131yla korunabilmesi i\u00e7in devlete edim y\u00fckleyen haklar\u0131n da tan\u0131nmas\u0131 gerekmektedir. \u00d6rne\u011fin mahkemelerde \u00e7evirmen tahsis edilmesi ne tolerans ne de pozitif edim olarak de\u011ferlendirilmelidir; bu, adil yarg\u0131lanma hakk\u0131 kapsam\u0131nda bir y\u00fck\u00fcml\u00fcl\u00fckt\u00fcr.&nbsp;<\/p>\n\n\n\n<p>Sadece dil haklar\u0131 de\u011fil, k\u00fclt\u00fcrel ve sosyal haklar\u0131n; dayan\u0131\u015fma haklar\u0131 olarak da isimlendirilen \u00fc\u00e7\u00fcnc\u00fc ku\u015fak haklar\u0131n birey eksenli olmamalar\u0131 sebebiyle uygulanabilirlikleri tart\u0131\u015fmal\u0131d\u0131r.&nbsp;Genel kabul g\u00f6rm\u00fc\u015f olan birey merkezli hak anlay\u0131\u015f\u0131ndan farkl\u0131 olduklar\u0131 i\u00e7in hen\u00fcz \u201cyerle\u015fik\u201d insan haklar\u0131 kategorileri aras\u0131nda kabul edilmemektedir.&nbsp;Medeni ve siyasi haklar bireye dair ve hak ihlaline dayal\u0131 olduklar\u0131ndan somut ihlal halinde hukuki yollara ba\u015fvurulabilir. Ancak k\u00fclt\u00fcrel ve sosyal haklar, birey (hak) merkezli medeni ve siyasi haklardan farkl\u0131 olarak, devlet (y\u00fck\u00fcml\u00fcl\u00fck) merkezlidir. Bu hak gruplar\u0131nda hak ihlalleri de\u011fil haklar\u0131n kullan\u0131lmas\u0131n\u0131 k\u0131s\u0131tlayabilecek devlet uygulamalar\u0131n\u0131n \u00f6nlenmesi ama\u00e7lanmal\u0131d\u0131r (Beddard &amp; Hill\u2019den aktaran Aral, 2010).&nbsp;<\/p>\n\n\n\n<p>Temel insan haklar\u0131n\u0131n ba\u015f\u0131nda gelen ya\u015fam hakk\u0131n\u0131n ya da i\u015fkence yasa\u011f\u0131n\u0131n tart\u0131\u015fmaya a\u00e7\u0131k olmamas\u0131 ancak dil haklar\u0131yla ilgili uluslararas\u0131 belgelerde devletlere se\u00e7im hakk\u0131 tan\u0131n\u0131yor olmas\u0131 y\u00f6n\u00fcnden inceledi\u011finde dil haklar\u0131n\u0131n temel haklar mertebesinde olmad\u0131\u011f\u0131 ve temel haklar \u00e7er\u00e7evesinde verimli \u015fekilde korunmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.&nbsp;Dil haklar\u0131 bu haktan tamamen ayr\u0131, anadili resmi dilden ba\u015fka olan az\u0131nl\u0131klar i\u00e7in e\u015fit \u015fartlar\u0131n sa\u011flanmas\u0131 ama\u00e7l\u0131d\u0131r; \u00f6zel olarak d\u00fczenlenmeli ve devletlerin pozitif edimleriyle korunmal\u0131d\u0131rlar.&nbsp;<\/p>\n\n\n\n<p>Anayasan\u0131n,&nbsp;<em>Anayasan\u0131n Ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 ve \u00dcst\u00fcnl\u00fc\u011f\u00fc<\/em>&nbsp;ba\u015fl\u0131kl\u0131 11. maddesine g\u00f6re \u201cAnayasa h\u00fck\u00fcmleri, yasama, y\u00fcr\u00fctme ve yarg\u0131 organlar\u0131n\u0131, idare makamlar\u0131n\u0131 ve di\u011fer kurulu\u015f ve ki\u015fileri ba\u011flayan temel hukuk kurallar\u0131d\u0131r\u2026\u201d. Temel haklar Anayasa\u2019yla d\u00fczenlenmi\u015ftir. Buna g\u00f6re temel haklar da iktidar erklerini ve iktidar\u0131n ta\u015f\u0131y\u0131c\u0131lar\u0131 ile bireyleri ba\u011flar. Temel haklar\u0131n bireyleri ba\u011fl\u0131yor olmas\u0131 bireyler aras\u0131nda meydana gelen \u00f6zel hukuk (aile hukuku, bor\u00e7lar hukuku, ticaret hukuku \u2026) ili\u015fkilerini de kapsamaktad\u0131r. Ancak dil haklar\u0131 \u00f6zel hukuktan kaynaklanmamaktad\u0131r, devletin d\u00fczenleme ya da tolerans g\u00f6stermesiyle ilgilidir (G\u00f6ren, 2000).&nbsp;Devlete negatif edim y\u00fckleyen haklar, kar\u0131\u015fmama politikas\u0131, ancak halihaz\u0131rda ileti\u015fim dili olarak kullan\u0131lan diller i\u00e7in ge\u00e7erli olabilir.&nbsp;Ancak \u00e7al\u0131\u015fman\u0131n konusu olan b\u00f6lge leh\u00e7esi yak\u0131n zamanda kaybolmas\u0131 beklenen dil ve leh\u00e7elerdendir. Bu sebeple \u00c7ukurova B\u00f6lgesi Arap leh\u00e7esinin korunmas\u0131 ve canland\u0131r\u0131lmas\u0131 gereklili\u011fi s\u00f6z konusu oldu\u011fundan&nbsp;s\u0131n\u0131rl\u0131 koruma sa\u011flayan haklarla hayata d\u00f6nd\u00fcr\u00fclmesi m\u00fcmk\u00fcn de\u011fildir.&nbsp;S\u00f6z konusu leh\u00e7e kaybedilmekte oldu\u011fundan, topluluk a\u00e7\u0131s\u0131ndan dil haklar\u0131n\u0131n leh\u00e7enin korunmas\u0131 ve canland\u0131r\u0131lmas\u0131na y\u00f6nelik \u00f6nlemleri de i\u00e7ermesi gerekmektedir.&nbsp;Di\u011fer bir deyi\u015fle, \u00c7ukurova b\u00f6lgesi Arap leh\u00e7esine ba\u011fl\u0131 dil haklar\u0131n\u0131n d\u00fczenlenmesinde kamu kurumlar\u0131n\u0131n aktif rol \u00fcstlenmeleri gerekece\u011finden bu kurumlar\u0131n Anayasalarda tan\u0131nan pozitif edim y\u00fckleyen haklarla ilgili s\u00fcrece kat\u0131lmas\u0131 gerekmektedir.&nbsp;<\/p>\n\n\n\n<p>Devletlerin tarihten gelen egemenlik temelli kayg\u0131lar\u0131 do\u011frultusunda hareket etmeleri \u00e7o\u011fu zaman demokratikle\u015fme ve insan haklar\u0131 konusundaki geli\u015fmeleri engellemektedir.&nbsp;&nbsp;Bu durumdan en \u00e7ok nasibini alan ise dil haklar\u0131n\u0131n da i\u00e7inde bulundu\u011fu \u00fc\u00e7\u00fcnc\u00fc ku\u015fak haklard\u0131r.&nbsp;<\/p>\n\n\n\n<p>Hak taleplerini \u015fekillendiren ana etmen tehdittir. Varl\u0131\u011f\u0131 tehdit edilen de\u011ferler, sahipleri taraf\u0131ndan muhafaza edilmek istenirler ve bu istek do\u011frultusunda hak talepleri olu\u015fur. Ayn\u0131 \u015fekilde dil haklar\u0131 da birey ve topluluklar\u0131n kendi dillerini tehdit alt\u0131nda hissettikleri d\u00f6nemlerde \u00f6n plana \u00e7\u0131km\u0131\u015ft\u0131r. G\u00fcn\u00fcm\u00fczde de dil haklar\u0131 ve dil politikalar\u0131, d\u00fcnya \u00e7ap\u0131nda ya\u015fanan dilsel \u00e7e\u015fitlili\u011fe ba\u011fl\u0131 \u00e7eki\u015fmelerden ve her ge\u00e7en g\u00fcn daha fazla dil ve leh\u00e7enin kaybolmas\u0131ndan dolay\u0131 gittik\u00e7e daha \u00e7ok g\u00fcndeme gelir olmu\u015ftur.&nbsp;<\/p>\n\n\n\n<p>Tarihte dil, ulus\u00e7uluk hareketlerinin yo\u011funla\u015ft\u0131\u011f\u0131 d\u00f6nemlerde g\u00fcndeme gelmi\u015ftir. Ayd\u0131nlanma d\u00f6neminde dilin ileti\u015fim arac\u0131 olma \u00f6zelli\u011fi \u00f6ne \u00e7\u0131kmaktayken 18. y\u00fczy\u0131l sonlar\u0131nda ortaya \u00e7\u0131kan Romantizm ak\u0131m\u0131yla birlikte dilin kimli\u011fin ifadesi olma \u00f6zelli\u011fi \u00f6ne \u00e7\u0131km\u0131\u015ft\u0131r. 18. y\u00fczy\u0131l s\u00fcresince dil, ulusal k\u00fclt\u00fcr\u00fcn yay\u0131lmas\u0131n\u0131n entelekt\u00fcel sebebi olarak sunulmu\u015f, ulus-devletlerin olu\u015fumunda kullan\u0131lan ara\u00e7lar\u0131n ba\u015f\u0131nda gelmi\u015ftir. Bu d\u00f6nemde dil, ulus\u00e7ulu\u011fun kalbi halini alm\u0131\u015ft\u0131r. \u0130mparatorluklar\u0131n da\u011f\u0131ld\u0131\u011f\u0131 d\u00f6nemde topluluklar\u0131n etnik k\u00f6kenlerini sembolize etmi\u015f, ba\u011f\u0131ms\u0131zl\u0131k sa\u011fland\u0131ktan sonraysa \u00fclke i\u00e7inde dil birli\u011fi temin edilmek istenmi\u015ftir. Bu d\u00f6nemde hem homojen toplum yaratma hem de modernle\u015fme gereklili\u011fi dil politikalar\u0131n\u0131n uygulanmas\u0131n\u0131 gerektirmi\u015ftir (Wright, 2016).&nbsp;<\/p>\n\n\n\n<p>\u0130kinci D\u00fcnya Sava\u015f\u0131 sonras\u0131 BM ve So\u011fuk Sava\u015f sonras\u0131 Avrupa Konseyi ile AG\u0130T\u2019in ba\u015f\u0131n\u0131 \u00e7ekti\u011fi uluslararas\u0131 insan haklar\u0131 \u00e7al\u0131\u015fmalar\u0131 ve belgeleri ortaya \u00e7\u0131kt\u0131klar\u0131 d\u00f6nemlerin ihtiya\u00e7lar\u0131 do\u011frultusunda \u015fekillenmi\u015f ve \u00e7at\u0131\u015fma d\u00f6nemlerinde hayal dahi edilemeyecek baz\u0131 \u015fartlar\u0131n devletler taraf\u0131ndan kabul edilmesini ve hatta mevzuatlar\u0131nda de\u011fi\u015fiklikler yap\u0131lmas\u0131n\u0131 sa\u011flam\u0131\u015ft\u0131r.&nbsp;<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Yine \u0130kinci D\u00fcnya Sava\u015f\u0131\u2019n\u0131 takip eden s\u00fcre\u00e7te ya\u015fanan kitlesel g\u00f6\u00e7lerle birlikteyse bir\u00e7ok farkl\u0131 dil birbiriyle kar\u015f\u0131la\u015fm\u0131\u015f; bu durum anadilin korunmas\u0131 ve asimilasyona kar\u015f\u0131 koyma e\u011filimi ba\u015flamas\u0131na yol a\u00e7m\u0131\u015ft\u0131r.&nbsp;<\/p>\n\n\n\n<p>Bu d\u00f6nemi takip eden on y\u0131llarda ise artan g\u00f6\u00e7, t\u00fcm d\u00fcnyada ya\u015fanan k\u00fclt\u00fcrel de\u011ferlerde ve geleneklerde etnik fark\u0131ndal\u0131\u011f\u0131n artm\u0131\u015f olmas\u0131 ve uluslararas\u0131 \u00f6rg\u00fctlerin etkinlikleri dil haklar\u0131 ve politikalar\u0131n\u0131 g\u00fcndeme ta\u015f\u0131m\u0131\u015ft\u0131r.
